| 摘 要： | 商业秘密作为知识产权的新的客体形式,自90年代以来迅猛发展。TR IPS特别将商业秘密纳入知识产权保护的范畴,专门系统地对商业秘密作了规定,在WTO体制下这无疑具有重要意义。本文立足于TR IPS对商业秘密的界定和法律保护制度的规定以及各国商业秘密保护法律制度,分析了我国商业秘密保护法律制度在相关方面的不足,并提出改进意见。

| Abstract: | The commercial secrets,as a new type of object of the intellectual property,have developed rapidly since the 1990s.TR IPS particularly include the commercial secrets into the protection scope of the intellectual property,making special and systematical regulation to the commercial secrets,which undoubtedly has great significance under the system of WTO.This essay,based on the definition of the commercial secrets and the legal protection system in TR IPS as well as some typical countries' legal system to protect the commercial secrets,analyzes the defaults of the legal protection system of the commercial secrets in our country in relating aspects and puts forward some suggestions for improvement. |
