| 摘 要： | 精神损害赔偿一直不适用于刑事附带民事诉讼案件.随着我国社会的全面发展,将刑事附带民事诉讼的赔偿范围扩大到精神损害赔偿的要求越来越迫切.将刑事附带民事诉讼赔偿范围限定为物质方面的损失,与宪法的规定相抵触,不利于保护被害人的利益,不利于协调法律体系内部的矛盾,导致法律价值的缺失,已不适应社会发展的趋势.

| Abstract: | Mental harm compensation has not been applied to criminal case appending civil lawsuit,along with the overall development of our country,the request that criminal suit with civil action attached should be applicable to mental harm compensation is getting more and more urgently.It is not accordant with the constitution that the scope of criminal suit with civil action attached is restricted to material loss,this is not good for protecting the victims' interests,not good for coordinating the internal legal system contradictions,it will lead to the loss of the values of law,it is not fit for social development |
