| 摘 要： | 格式条款的积极方面在于节约交易成本,消极方面则是对合同自由原则的违背及其可能带来的实际侵害缔约相对方合法权益的后果,因此在法律中必须对格式条款进行适当的规制.运用"完备合同"这一理念,从合同的现实履行为出发点,综合运用立法、司法和行政方法来全面规制格式条款,可以充分彰显其积极价值而抑制其消极影响.

| Abstract: | The pattern term's advantages lies in two aspects: economizing the business costs and making people reach the goal of money. However it's disadvantages is it may infringe the consumers' interests. So we must regulate the pattern term by means of legislation, judicature and administration to protect the consumers and the social economic orders. |
