| 摘 要： | 监护制度是一项重要的民事法律制度,然而,由于诸多原因,我国监护制度仍然存在不少缺陷:亲权与监护划分不清;监护种类和体系混乱;缺乏监督制度等.随着我国经济社会的发展,存在大量缺陷的监护制度日益无法满足保护未成年人和限制行为能力人的需要.

| Abstract: | The guardiaship susten is an important system of the civil law.But because of some reasons,there are still some shortcomings in this system: no clear classification between the relative right and guardiaship;the guardiaship and the system are mixed togather;lack of guardiaship system and so on.With the society developing,such kind of guardiaship system can't meet the needs to protect the people under age and limit onse's actions. |
