| 摘 要： | 公司法人是人的理性高度发展的产物，是最具优越性的所有权主体形式，然而，对于一个不享有充分产权的法人，充其量只不过是一个空洞的组织形式，这一点充分体现在我国的全民所有制企业中，我国应尽快突破所有制局限，确立国有公司法人所有权。

| Abstract: | The legal person of a company is the result of the great development of one's rationality, and is the superior subject of ownership. However, if a legal person does not fully enjoy the right of property, legal person is nothing but a title. This is embodied in the enterprises owned by the whole people. The obstacles in such enterprises must be overcome as soon as possible to establish the ownership of the legal persons. |
