| 摘 要： | 一般而言,结果犯以法定的结果作为其成立要件,其无未遂形态。但鉴于司法实践的需要与理论上的不统一,我们不得不承认危险犯应为相应结果犯的未遂形态、形态结果犯具有未遂形态以及一些个罪如盗窃罪存在未遂形态。

| Abstract: | Generally speaking,the important integral part of the establishment of consequential offense is based on the legally recognized result.However,we have to admit that perilous crimes should be deemed as a kind of abortive form of consequential offense because there still exists some difference between the judicial practice and the theories.Configuration consequential offenses could take on the abortive forms,and some crimes,for example,could occur in the form of the crime of theft that could also be abortive. |
