| 摘 要： | 从证据学的角度而言，经济犯罪与其他刑事犯罪相比较，在证据内容，证明关系，形式要件，证据的合法性等方面具有一定的共性，但学界对经济犯罪的证据特性研究与认知不够，经济犯罪的证据特性可归纳为可计量性，高技能性，多附带性，新复合性，从而，在司法控诉的过程中，时常遇到对经济犯罪的控诉举证不实，举证不当，举证不合法，举证不足，举证不力等方面的问题，并因此影响到定罪量刑的质量。

| Abstract: | From the viewpoint of studies of proofs,econmic crimes and other penalty crimes have in common such things as the content of the evidence,identification relationship,formal conditions and the legality of the evidence. But academic circles haven't done enough research work in this field. This article concludes that the proofs of economic crimes are characterized by their countability, hi-tech, concealment, multi-attachment and new combinations. During the course of accusation of economic crimes, untrue, improper, illegal or inadequate evidences may occur and they will influence the quality of sentence. |
