| 摘 要： | 对行政垄断的概念目前学界虽无争议但有不同认识。行政垄断是国家各级各类行政机关违法行使职权，排斥、限制、禁止市场竞争，破坏社会主义市场经济竞争关系的行为。行政垄断具有主体特殊性，行为的强制性与隐蔽性、动机与目的的多样性及政治危害性等特点。
