电子合同纠纷管辖的确定

进入21世纪后,互联网正以惊人的速度和影响力渗透到中国人的生活中。而从法律的角度看,有关互联网的立法明显滞后。电子合同的纠纷也愈演愈烈,其中以确定管辖为解决纠纷的基础。文章认为电子合同的管辖仍应适用民事诉讼法侵权案件管辖的有关规定,在分析侵犯权行为中,应当结合具体案情确定侵权行为实施地为管辖地。同时仅有交互性网址并不能确定原告所在地法院享有管辖权。最后,建议完善立法,将原告住所地作为网络侵权案件管辖地。

The legislation on the internet is obviously lagging when entering the 21st century while the internet are greatly effecting our life,and the entanglement of electronic contract is getting serious more and more in which the venue determination is the basis.The author thinks that the code of civil law is also applicable to the management of electronic contract when analyzing tort.The tortious locus is the venue.At the same time,we are uncertain that the forum domicilii of accuser is the venue only by the mutual URL.At last,we should develop our legislation and confirm the forum domicilii of accuser is the venue.
