| 摘 要： | “分工负责，互相配合，互相制约”原则在我国《刑事诉讼法》中居于基本原则地位，与其他原则在内容上重复规定，造成公安司法机关在诉讼职能上的矛盾和混淆，导致我国刑事诉讼司法实践中出现一些落后的现象。这是一个被国情论严重误导的基本原则，修订《刑事诉讼法》时必须予以废除。
