| Abstract: | This paper analyzes the current legislative status and the theoretical controversial regarding the marital rape at home and broad on the basis of one case.It demonstrates the reasons of regarding marital rape as a crime and relative justice finds as well as the practice principles in order to clarify the reason of punishment and protect women's right. |
