检察机关提起刑事附带民事公益诉讼问题研究——基于黄河流域125份判例的实证分析

2018年《检察公益诉讼》实施以来,刑事附带民事公益诉讼案件与日俱增,突显司法效益性和卓越实用性。通过分析黄河流经九省125份一审判决文书,发现问题集中表现在诉前程序、合议庭组成形式、承担责任以及惩罚性赔偿等方面。该制度需要不断探索优化,包括规范诉前程序,确定审判组织形式,实施多元化责任承担方式,建立生态损害赔偿基金以及明确惩罚性赔偿的适用条件等,为黄河流域检察公益诉讼发展保驾护航,并进一步完善我国的公益诉讼。

Development of Criminal Incidental Civil Public Interest Litigation:an Empirical Analysis Based on 125 Cases in the Yellow River Basin

Since the implementation of the“Public Interest Prosecution”in 2018,the number of criminal incidental civil public interest litigation cases has increased day by day,highlighting judicial effectiveness and excellent practicality.Through the analysis of 125 first-instance judgment documents of the Yellow River flowing through nine provinces,it was found that the problems were concentrated in the pre-litigation procedures,the formation of the collegiate panel,the assumption of liability and punitive damages.The system needs to be continuously explored and optimized,including standardizing pre-litigation procedures,determining the form of trial organization,implementing diversified responsibilities,establishing an ecological damage compensation fund and clarifying the applicable conditions of punitive damages,etc.,to escort the development of public interest litigation in the Yellow River Basin.And further improve my country’s public interest litigation.
