法经济学关于交易成本理论是我们认识行政许可法的又一全新视角。法律制度的生成及实施是需要交易成本的,行政许可法也不例外。如何合理确定行政许可行为的边界、行政立法的技术标准与规则以及法律适用等过程中都存在着不同成本收益的考量。行政许可法本质上其实是一种界定政府行为与市场活动的最密切联系的法律。着眼于行政许可法的交易成本的有效降低,对许可制度在程序和内容上进行均衡安排,实行以宪政民主为核心的“善治”。

Economics Analysis of administrative license law: From a Vision of Transaction Cost

The theory of transaction cost in economics of law offers a new perspective for us to understand administrative license law.For any law to be generated and enforced,it needs transaction cost,and administrative license law is no exception.There are different costs-benefits considerations in deciding the margin of administrative license behavior,the technical standard of administrative legislation and the relevant legal application.Based on the theoretical elaboration of legal transaction cost,administrative license law is considered in to be the most effective law to link the government and the market.Through the effective reduction of the transaction cost of administrative license law and the balanced planning of the procedure and content of licensing mechanism,a 'good governance' with constitutional democracy as its core can be realized.
