死刑复核程序现存问题及完善之构想

死刑复核程序作为我国独具特色的程序制度，在严格适用死刑，防止错杀、滥杀，保障被告人权利和打击犯罪等方面都具有极为重要的作用，是为了保证死刑质量而设置的最后一道程序保障。然而在实践中，无论是在立法、司法、还是理论中，都产生了一些不容忽视的问题，导致难以圆满实现设立的初衷，因此，有必要加以修改和完善。
