| 摘 要： | 通过追溯最密切联系原则的历史发展,从理论、实践层面阐述了其在侵权责任领域中适用的时代必然性,从价值层面揭示了在侵权责任领域中引入最密切联系原则的意义,并对多年来的司法实践所折射出该原则的隐患进行了分析,对其予以重新审视与合理定位,进一步加以规范、修正,以使该原则不断发展完善。

| Abstract: | The article expounds the time inevitability of the Doctrine of the Most Significant Relationship applying to the realm of the tortious liability by way of casting back its history development from the theoretical and practical aspects;also it indicates the significance of it from the valuable aspect and analyzes the hidden trouble of it in the judicial practices of many years in order to make the doctrine develop more perfectly,and then gives the new survey and reasonable orientation to it for its specification and modification. |
