摘    要:“重实体轻程序”是我国目前的司法现状,其背后则是功利主义的动机,而中国儒家文化推崇人文主义,反对功利主义,因此,我们需要对儒家经典重新解读,从儒家文化中寻觅适合中国国情的法治道路,真正实现法律资源的本土化。

Abstract:China' s current judicial status quo reflects too much emphasis on entity and too less on proce- dure, which is motived by utilitarianism. But Confucian culture thinks highly of humanism and opposes utilitari- anism, therefore, a new interpretation of Confucian classics is in urgent call to lead people to find a more effec- tive way of the rule of law in accordance with the situation of Chinese path, and to realize the localization of legal resources.
