| 摘 要： | 诚实信用原则作为一般条款在合同法的订立和履行中得以应用,成为合同法的一项极为重要的原则。本文阐述了契约责任扩大化的法哲学基础,同时也在诚实信用原则的指导下探讨了我国合同法的不足之处,以此期望对21世纪合同法现代化的发展趋势有一个正确的认识。

| Abstract: | One of the very important principle of the law of contracts is the principle good faith, which is used as a common clause in making and fulfilling the law of contracts. The author expounds the foundation of philosophy of law of enlarged duty of treat meat and explores shortcoming of the law of contracts is china through process of emergence of intended interest and fauit liability on signing a treaty in order to find the developmental trend of the law of contract in 21 century. |
