体育竞赛与版权保护

版权或称著作权是知识产权的重要组成部分,法律的一个分支.我国现行的著作权法对保护的范围作了规定,也列出了一些限制性条款.体育领域中的智力成果的表现形式是多种多样的,有些可以成为著作权保护的客体,有些则不能.这个问题解决得如何体现了我国体育领域知识产权保护的水平.认为体育竞赛项目以及体育竞赛中技战术不适合著作权法的保护,著作权法保护的是智力成果的表现形式即作品,不保护其内容.

Sports competition and copyright protection

Copyright is an important constitutional part of intellectual property right and a branch in law. The copyright law currently in effect in China has defined the scope of protection and listed some restrictive provisions. The expressing forms of intellectual achievements in sports area present are varied,some of which can become the object of copyright protection while the others cannot. How this problem being solved represents the level of protection of intellectual property right in sports area in China. The author considered that sports competition events and the techniques and tactics employed in sports competition were not suitable for copyright protection,and that what the copyright protects was the expressing form of an intellectual achievement,namely,the works,but not the contents.
