后TRIPS时期地理标志法变革与中国的对策

后TRIPS时期地理标志法变革历经17年尚未成功。成员方及学者对谈判议题还有争议。TRIPS及部长会议宣言表明,葡萄酒和烈酒多边注册体系是有明确授权的谈判议题,把对葡萄酒和烈酒地理标志的额外保护扩展到其他产品这一问题则还不是公认的谈判议题。最新报告反映,注册体系谈判中的分歧已经减少,扩展方面则观点对立。谈判可能要延续到2013年。以调研报告为依据,拟定多层次谈判目标,从程序上把扩展问题纳入谈判议题,进行有选择的议题交换和多头推进等是中国可以采取的对策。

A Study on the Reform of the Geographical Indications Law in Post-TRIPS and the Strategies of China

Although proceeding for 17 years,the reform of the GIs law in the post-TRIPS period has not succeeded.Members and scholars hold different opinions about the issues related to the negotiation.According to TRIPS Agreement and ministerial declaration,what has got a specific negotiating mandate is the establish ment of multilateral system of notification and registration of GIs for wines and spirits,but not the issue related to extension.Divergence in the negotiation of registration system has been reduced,but it is opposite in the de bate about the extension.Doha negotiation will prolong to 2013.To draw up multi-level negotiation goals,to list the extension into negotiation issues,to exchange between issues,to promote the protection of GIs through multiple means,and others,are strategies that China should take.
