| 摘 要： | 为了社会财富分配的公平及其继承人之间利益的平衡和保护,我国《继承法》对缺乏劳动能力又无生活来源的人和胎儿进行了特殊保护,规定了必继份制度,但该制度存在许多缺陷,影响立法意图的实现。我国在立法上应当引入特留份制度,并根据我国国情加以改造,建立有中国特色的遗产特留份制度。
