| 摘 要： | 本文基于法律概念的不确定性面向,提出法律概念不确定性来源于语意的自我规定性、模糊性、评价性、流变性,法律概念既有其不可替代的意义,也有不可化约的缺陷。通过“概念”与“类型”的比较,凸现类型对概念的弥补作用,说明“概念 类型”模式的方法论意义。

| Abstract: | This essay is based on the indeterminacy of legal concept,which comes from the self-restriction,vagueness,valuation,mobility of meanings.There is not only significance on legal concept which cannot be substituted but also limitation which cannot be raveled out.However,the type can remedy the limitation of legal concept.In the end,the author shows the methodology significance of the "Concept plus Type" pattern.. |
