| 摘 要： | 从民法角度探讨网上预约借书制度，界定读者与图书馆之间的民事法律关系。基于要约、承诺、合同成立等理论对读者提出图书预约申请和图书馆提供预约图书的行为进行分析，认为对读者滥用图书预约权的行为可比照缔约过失责任进行处理。指出可通过图书馆对读者提出新要约、对违规读者取消其预约权等措施来避免读者滥用图书预约权的行为。

| Abstract: | This paper firstly defines the civil legal relationship between readers and the libraries, to research book borrowing reservations on network from civil law perspective. Then it analyzes the theories of offer, commitment, establishment of contract and others that apply to readers who reserve books borrowing and libraries which provide books reservation services. Readers' misuse of book reservating right can be dealt with according to contracting fault liability. It also damages other readers' right to gain information. Libraries can make new offer for readers, and cancel illegal readers' reserving rights of borrowing books, to prevent this kind of behaviors. |
