| 摘 要： | 民族区域自治地方立法既是自治地方的自治权,又是自治地方行使自治权的重要保障。这个保障首要的内容,包括民族立法通过有效变通的过程和有效变通的环节,保障法律变通的实现。变通途径实现了,就为法律实现开辟了一条十分重要的途径。因此,民族自治地方的立法变通途径,从广义上说是指民族自治地方对上位法有权制定、批准制定、监督制定变通规范性法律文件的活动的途径,其内容涵盖有权制定、批准制定、监督制定变通的机关、种类、范围、程序、原则等。
