| 摘 要： | 论述了版权法和专利法中与体育有关的主要内容:版权保护;版权所有者的权利;版权的合理使用及权利的限制;版权中电视和收音机传播,并在此基础上着重分析讨论了与体育赛事有关的版权和专利问题。比赛中新的技战术没有专利;体育赛事本身没有版权;体育赛事转播具有版权,著作权的归属由赛事主办者与电视台通过合同约定。

| Abstract: | In this paper,fundamental concepts related sports are discussed in copyright and patent law :copyright protection;rights of copyright owner;fair use and rights restrictions;television and radio broadcasting;an analysis of problems related to copyright and patent in sports competition is made on the basis.The conclusions are:New competition skills and tactics should not have patents;Sports competition should not have copyright in itself;Sports competition broadcasting should have copyright which could be owned by competition host or television station through signing a contract. |
