《物权法》若干概念释疑——《物权法》研究之一

对《物权法》相关概念的解释，应当立足于文义解释，结合其他解释方法探讨其意义。比如，财产“利用”包括物权性的和债权性的利用关系，《物权法》所规范的财产利用关系以及主要限于物权性的利用关系；查询物权变动登记资料的“利害关系人”也并不限于有法律上权利义务关系的人；对财产的“处分”，应当具体分析，它可能包括事实上和法律上的处分，也可能限于法律上的处分甚至仅仅是转让一项权利。

Interpretations of Some Concepts in Property Law

The interpretations of some concepts in Property Law should be based on literal expatiation, and combined with other ways of explanation. For example, the ＂use＂ of property can involve the relation of employment between property rights and creditor＇s right. Such relation standardized by the law is mainly confined to the use of property rights. The person related directly to the advantage and disadvantage who consults the registered information of property is not confined to one who is endowed legal rights or responsibility. The treatment of property should be done carefully, which may include factual and legal treatment, or may be only confined to the legal handling, e.g. attorning a right.
