排污权初始分配的有偿性研究

排污权初始分配在计划经济时代是以无偿为特征、以多数人为少数排污者支付环境容量资源为代价的。在转型时期，我国建立了排污收费制度，初步确立了隐性的排污权有偿分配制度，但相关法律规定是分散的、不一致的，随着开放的扩大和市场经济体制的建立，有必要进一步改变“环境无价”的观念，建立显性的有偿分配排污权的机制。

In the transition period, Chinese government has set up levying policy of pollutant discharge and indistinct non-gratuitous distribution of discharge right. However, the related laws are out of harmony. With further open up and the market economic system establishing it is necessary to change the concept that environment resource is gratuitous and establish a non-gratuitous discharge system in the primary distribution.
