电子政务的法律现状、困境与出路

信息技术的高速发展促生了一种新的行政管理模式——电子政务,其优点不言而喻,但各种问题也日益凸显,究其原因主要在于电子政务法律法规的缺失。依法行政是现代行政法的核心与首要原则,作为行政的网络表现形式——电子政务也必须遵循该原则。但我国电子政务立法却表现出无纲领性立法、无确定立法规则、无有效的立法评价及监督机制的"三无"状态,所以我国必须从宏观和微观层面改进电子政务立法。

E-government's Current Legal Situation, Predicament and Solutions

The rapid development of information technology helps to bring about a new administrative management model,E-government.Although its advantages are self-evident,various problems are becoming obvious because of lacking laws and regulations for E-government.Conducting administration according to law is the core and primary principle of modern administrative law.Thus,E-government should also conform to the principle as a network manifestation of administration.However,the E-government in China lacks programmatic legislation,legislative rules and effective evaluation,and supervision mechanism.Thus,China should improve legislation for E-government on both micro and macro levels.
