经济法价值的分析与比较--关于经济法存在的价值依据及其存在的必要性

要：经济法价值是经济法一个重要的理论问题。经济法之所以能够在纷繁复杂的法律体系中占有一席之地，根源在于其特殊价值。在实质正义、社会效益、经济安全和平衡协调几个方面，经济法与民法均有着不同的调整对象，从而呈现出经济法作为独立的法律部门存在的价值依据，亦说明了经济法存在的必要性。

The Analysis and Comparison of Economic Law''''s Value--An Investigation of the Value Basis for the Existence of Economic Law and the Necessity for Its Existence

The value of economic law has been a key theoretical problem of economic law. The existence of the economic law among the complicated law system can be attributed to its special value. This paper analyzes and compares the value of economic law with civil law by focusing on the values of justice essence, social profits, economic safety and ordination, distinguishing the different regulating subjects of economic law and civil law. By doing so, we identify the value basis for the existence of economic law as an independent department in the law system, and therefore indicate the necessity for the existence of economic law.
