| 摘 要： | 利他合同第三人权利保护在英美法系和大陆法系都较为成熟，但我国《合同法》并未确立第三人权利制度。通过历史法学派法律进化的法史研究方法可发现，该制度在崇尚契约自由、保护信赖利益和节约交易成本等方面有特殊的价值。因此，建议在该制度建构方面可通过赋予第三人直接请求给付权、损害赔偿请求权、强制履行请求权和解除合同的参与权等方式完善对第三人之权利的保护。

| Abstract: | The protection of the right of the third party develops more mature in continental law system and common law legal family.However,Chinese contract law has not adopt the system.According to the historical evolution of the law,it could be found that the system plays an important part on the freedom of the contract,protection of the trust in the interests of the inherent and the saving of the resourses.Therefore,we could perfect the protection of the right of the third party with the method of giving the right of a direct request for payment,claiming for damages,mandatory performance request and the involvement of the right to cancel the contract to a third party. |
