| 摘 要： | 短期自由刑的存废一直都是国际刑法学界争论不止的问题。作为自由刑的一种,其弊端已经在实践中日益凸显。但是,据此将短期自由刑彻底否定也有失偏颇,应根据国情改革完善,易科罚金,易利社会服务,改善拘役执行制度不失为扬长避短的好方法。
