论现代行政法基本原则的确立及其对行政法律文化创新的作用

行政法的基本原则和行政法律文化虽是两个不同的法学范畴，但二者之间具有内容、功能和价值上的共识性。法律原则带有文化：巷识上的导向性，行政法基本原则无论对制度性法律文化的建构还是对观念性的法律文化的建构都具有指导和推动作用。当代中国正处于社会的总体转型时期，要想实现行政法律文化的创新，需要确立现代行政法的有限权力原则、正当程序原则和责任行政原则，通过现代行政法基本原则的导引，实现社会主体行政法律意识的创新，完成行政法律文化从传统到现代的转型。
