论我国消费者公益诉讼的若干问题

在我国建立消费者公益诉讼制度具有充分的法理基础和现实可行性,但也存在包括原告起诉资格障碍、判例的效力障碍、法律责任制度缺陷和法院职权有限、诉讼费用难以承担、激约机制和滥诉控制机制缺失等制度障碍,思考和解决这些问题是建立消费者公益诉讼制度的必须。

Some Problems Concerning the Consumers'''' Commonweal Lawsuits in Our Country

The establishment of the system of consumers' commonweal lawsuits in our country is based on the sufficient law foundation and has realistic feasibility,but still there are obstacles existing in accuser's accusation qualification,case effectiveness,the absence of legal liability system,limited jurisdiction,unpaid expense in litigation,the lack of incentive and restriction mechanism,and the control of the abuse of process.It is necessary to consider and solve these problems for the establishment of consumers' commonweal lawsuit system.
