| 摘 要： | 我国法学界长期将法律的目的与法律的价值等同，实际上法律的目的是对法律价值的追求和指向，它既受一定社会的物质生活条件所决定，同时还受法律、道德等既有规范的影响。法律的目的产生于法律实践并通过法律价值对法律实践进行评判。

| Abstract: | The legal goal is equated to the legal value in Chinese laws for a long time, actually the legal goal is aimed to pursue the legal value,which is not only determined by the certain material life conditions in our society,but also influenced by the norms such as the laws, morality, etc. The legal goal results from the legal practice which is eventually judged by its legal value. |
