“以德治国”的历史传统与当代特质

本文以肯定“依法治国”、坚持“两手抓”为前提 ,探讨“以德治国”的历史传统 ,认为中国古代历代统治者大都在政治上以儒家“德治”思想为指导 ,法制上以“德主刑辅”为核心。根据当今社会主义市场经济体制的特点 ,以道德的继承性和发展性为依据 ,扬弃地总结出当代“以德治国”的特质——以市场为根基、与科学和法治同行、并兼有实践性和理想性。

The Historical Tradition of Morality-govern-country and It''''s Current Character

Based on the premise that Law-govern-a-country is positive and that Two-hand-grasp is persistent, this paper deals with the historical tradition of Morality-govern-country Theory,thinking that in the past Long Long history of China rulers always regarded the Morality-govern idea as the guide and regarded the idea as the theme of legal system that morality is dominant but punishment is subdominant. According to the character of socialist market economic system and based on the inheritance and development of morality, this paper has drawn a conclusion of Morality-govern-country theory.In the present age,the theory has four characters:Basing on Market Economy; Depending on the science;Paying equal attention to both Lawgovern and Morality-govern;Combining practicality with idea feature.
