刍议信用证独立性原则的适用范围

独立性是信用证最根本的属性，是信用证制度得以存在和发展的基石。一般认为，独立性原则意味着信用证一经开立即与基础合同相分离，成为独立的法律文件。然而，结合实践中真实案例的分析发现，信用证的独立性并非绝对，它有特定的适用范围：从对象上来看，它仅适用于银行和受益人之间，不适用于买卖合同双方；从适用阶段上来看，它仅适用于自信用证开立时起至银行付款时止的一段期间，不适用于开证前或者付款后。而且，独立性原则并非意味着彻底剥离信用证与其基础合同的关系，某种程度上，信用证的存在能够印证基础合同的成立。
