关于制定《学校法》的思考

制定《学校法》是完善我国教育法律体系、建立和完善现代学校制度、完善学校的内部治理结构、落实学校依法自主办学、规范学校资产与财务管理、解决日益增多的校内纠纷的需要。应从我国的教育实际和特殊国情出发,在借鉴外来立法经验的基础上,明确《学校法》的立法目的、指导思想、体系和内容等。

Reflection on the legislation of "School Act"

Drawing up "School Act" is of great necessity for perfection of Chinese education law system,construction and perfection of modern school system,perfection of schools' internal governance structure,implementation of autonomous running of school according to law,standardization of assess and finance management in schools and resolving increasing disputes in schools.We should base on the education reality of our country,special national condition and foreign legislative experience to make clear the legislation goal and guiding ideology of "School Act",its system and content.
