法律原则与法学体系之走向--以封闭体系与开放体系之对比为线索

以法律规则为主导的体系是封闭的体系,以法律原则为主导的体系是开放的体系。封闭的体系由外部体系所构成,开放的体系由内部体系所构成。内部体系始终是开放的和流动的。功能性概念是架设在传统法律概念与法律原则之间的一座桥梁。从封闭体系向开放体系的倾斜,是法学在当代发生的一个重大转变。当然,在此过程中,封闭体系也有其功用。

Law Principle & Alignment of the Law System: With Clue of the Contrast of Close System & Open System

The system with law rule as the predominant is the Close System, the system with law principle as the predominant is the Open System. The Close System is composed with the exterior system; the Open System is constituted with internal system. The Internal System is always liberal & flowing. The function concept is a bridge installed between the traditional law concept & the law principle. It is a graveness change of law to inclination from the Close System to the Open System in the contemporary. Certainly, in this process, the Close System also has its effect.
