| 摘 要： | 中国法律史是高等学校法学专业的基础课程.它承担着传承传统法律文化、培养具有深厚传统法律文化素养的法律人才的重要任务.目前.该课程的教材体例、内容尚不能完全满足文化传承、人才培养的要求,存在不少问题.突出表现在:制度史与思想史分开设置,人为切断了二者的有机联系;课程以断代体例编排,体系杂乱;教材内容陈旧等等.其重构方案是:将制度史与思想史合并为一门课程;取总论与分论的编排体例;更新内容.将新中国法律制度、法律思想融入其中;进一步消除左的阶级观的影响,将当前法制建设可资借鉴的传统法内容在教材中做充分的反映和体现.
