刑事政策视野下我国商业秘密刑事立法的完善

随着全球知识经济的兴起和繁荣，商业秘密作为一种新型知识产权，世界各国均广泛地对其采用刑事保护。商业秘密刑事保护的强弱程度要依据一个国家在特定发展阶段所采取的刑事政策来确定。当前我国对商业秘密的保护应当采取弱势刑事政策。刑法应当取消过失侵犯商业秘密犯罪和违约行为犯罪化的规定，加大对商业间谍行为的打击力度。

On Improving Criminal Legislation of China Trade Secrets in the View of Criminal Policy

With the rise of global knowledge-based economy and its prosperity, trade secrets, as a new type of intellectual property, are widely protected by criminal law in the countries throughout the world. The strength of criminal protection on trade secrets is to be determined by the criminal policy adopted by the country at a particular developing stage. At present, China should take vulnerable criminal policy in trade secrets protection. Criminal law should abolish the provisions of negligence crime and criminalization of noncompliance, and increase efforts to crack down on the commercial espionage.
