犯罪构成要件的位阶性

大陆法系和英美法系的犯罪构成要件之间具有位阶的效力,这种位阶效力要归功于正当化事由的纳入,而我国犯罪构成是一种耦合式的犯罪构成,各个要件之间没有位阶关系。我国的正当化事由被排除在犯罪构成要件之外,而我国的犯罪构成又是一种实质性的犯罪构成,这不仅引起逻辑上的矛盾,还造成实践上对正当化事由的忽视,不利于保护被告人。因此,笔者建议将本属于犯罪构成要件的正当化事由纳入到构成要件之中,使得我国的犯罪构成具有位阶性。

The Ranking of Constitutive Elements of Crime

The constitutive elements of crime of continental law system and Anglo-American law system have effect of ranking,which is due to the bringing legitimate ground in,but the constitute of crime of our country law system hasn't effect of ranking among the constitutive elements.The legitimate ground is excluded by the constitutive elements of crime,which is a kind of a materiality constitute of crime,and it not only causes a logical antinomy,but also neglects the legitimate ground in practice and is disadvantageous to protect the defendant.So the author suggests that the legitimate ground should be brought into constitutive elements and make the constitute of crime of our country law system have effect of ranking.
