| 摘 要： | 社会募捐是指一定的单位和组织以自己的名义向全体社会成员或者特定范围的成员募集财物，以救助特定的对象。社会募捐和公益信托属于不同的法律制度，不能将社会募捐强行纳入公益信托的范畴。社会募捐属于附条件的第三人利益合同。根据第三人利益合同的相关理论，并综合考虑募捐合同的订立目的、社会价值等因素，解决社会募捐的相关纠纷。

| Abstract: | Social fund - raising is a certain degree of units and organizations in their own name to all members of society, or a specific range of members to raise their property in order to rescue a specific object. Social mobilization and public trust belong to different legal systems can not be forced into the Charitable Trust fund - raising areas. Fund - raising part of the conditions attached to the interests of a third party contract. According to third theory, the interests of the relevant contracts, and contracts entered into comprehensive consideration the purpose of fund -raising, social values and other factors, to resolve disputes related to the social fund- raising. |
