| 摘 要： | 诱惑侦查是司法实践中一种广泛使用的、行之有效的侦查方式,然其合法性一直以来是法学界和实务部门争议的焦点.在当今各种隐蔽性犯罪、无被害人犯罪日益增多的情况之下,诱惑侦查对于打击犯罪具有独特的优势,但同时我们必须从立法上规范诱惑侦查的使用,把这种侦查策略的负面影响减少到最小,兼顾刑事诉讼惩罚犯罪与保障人权两个价值目标的实现.

| Abstract: | Detection with tempertation is a kind of investigatory skills which is popularly and effectively applied in judicial practice.And whether it is valid or not is a focal point on jurisprudential circle and professional practice departments' disputation.Nowadays,the number of different kinds of hidden crimes and crimes without victim is increasing day by day.In this situation,detection with temperttion gains a particular advantage to fight against crime.But meanwhile considering the actualization of two valued aims punishing crime and protecting human right by criminal procedure,we must regulate the application of detection with tempertation by legislation and minimize its negative influence. |
