中国古代法制文学研究范围刍议

对中国古代法制文学加强研究具有十分重要的现实意义 ,它对当代法制文学创作和欣赏具有借鉴和指导作用。应进一步从内容到文体等多方面拓展中国古代法制文学研究范围 ,追溯“公案”渊源 ,突破“公案”题材束缚 ,研究揭露封建家族法规和封建伦理道德的作品以及人民盼望整治社会治安、惩治社会公害的作品。要对中国古代法制文学研究采取范围广阔、视角多维的方式方法 ,逐步使中国古代法制文学研究形成体系 ,为我国第一部《中国古代法制文学史》诞生奠定基础。

On Study Scope of Chinese Ancient Legality Literature

Strengthening the study of Chinese ancient legality literature has an important factual significance.Through which we can draw on experiences and guidance to create and appreciate contemporary legality literature.The study scope should be widened further from content to literary form,while tracing back origins of "complicated legal cases",smashing the shackles of subject matter,studying the works of exposing regulations of feudal clans and feudal moral principles and ethics,as well as those people's looking forward to put peaee and security in order,to fix social hazard,thus gradually shaping up the study system of Chinese ancient legality literature,and laying a foundation of the first Chinese Ancient Legality Literature History.
