服制刍议

服制是中国封建社会一项制度,是指亲属关系亲疏远近的制度,由于封建法律以伦常关系为重要依据,因此它又成为封建法律的重要组成部分,并作为刑事法律中判罪定刑的一个标准,在晋代就已经按服制定罪,明、清时将其置于法典的篇首,足见其在封建法律中的重要地位。

A Rustic Opinion Abont Mourning Apparel System of China

The mourning apparel system is a system in feudal China.Different mourning apparel system told respective kinship between relatives,it provided important criterion for moral human relations in feudal law of China,therefore,it became an important part of the feudal law.It was also used as the standard when criminating and determining what punishment to give to the criminals.Theconvition according to the mourning apparel system had started since Jin Dynasty,furthermore,it was placed in the first chapter in corpus juris of Ming and Qing Dynasty,so its basilic position in feudal law of China can be seen.
