| 摘 要： | 分析实证主义法学的基本观点和方法中预设了若干社会性事实作为其论证的前提和基础。以解构分析实证主义法学的内在理路,提炼出分析实证主义法学预设的社会性事实,运用自由主义社会理论对这些社会事实进行了批判,提出了分析实证主义法学更具真实社会基础的可能发展方向。

| Abstract: | Analytical-positivist jurisprudence presupposes some social facts as its precondition and basement of discussion in its essential points and methods.The paper abstracts analytical-positivist jurisprudence pre-supposes some social facts by disconstruct its demonstrative lines,then animadverts this social facts by social theory of liberalism, and gives the analytical-positivist jurisprudence some advice about its possible development direction. |
