| 摘 要： | 本文认为,公办教育的房地产属于公益性房地产,学校和其他教育机构是相应房地产的主体,学校的上级主管部门只能行使审批权,而不能行使处分权。本文探讨了不同类型的教育类房地产的相关土地权属,明确了不同情况下教育类房地产权利变更的法律限制。

| Abstract: | The authors hold that the real estate for educational sectors run by the government belongs to the public, and the property interests belong to schools and other educational institutes. The higher authorities only exert the power of examination and approval and are not in a position of disposing the property. The paper also probes into the property interests of various educational sectors, and specifies legal stipulations for any changes of the property interests in different cases. |
