中国少数民族法制史研究的进路

中国少数民族法制史是中国法制史的重要组成部分，故要在中国法制史研究的基础上拓展民族法制的内容．尽量将具有少数民族法制特色的内容挖掘出来，同时摆正以汉民族为主体的多民族国家发展中各民族法制的位置。因为，历史上的民族法制是中国法律发展史中的一部分，是在中华法系的大背景中产生和发展的。今天借助中国法制史和民族史研究的成果，少数民族法律史的研究已成为可能和必要的，这对于深入挖掘民族法律文化遗产，丰富民族法律文化研究成果，繁荣民族法学，加强现阶段民族法制建设都有非常重要的意义。

Approaching Legal History Study of China's Ethnic Minority Groups

Since the legal history of every ethnic minority group is an integral part of China＇s legal histo- ry, it is necessary to enrich research findings of China＇ s legal history by excavating as much as possible the legal history of every ethnic minority group with features unique to each ethnic group. Meanwhile, be- cause ethnic legal history, which occurred and developed in the context of the big Chinese legal system, is a component of the development of China＇s legal history, it is important to alloeate an appropriate place to the legal history of every ethnic group in the legal history, of this ethnically diversified nation as a whole with the ban as the principal ethnic group. Now the accomplishments made in our study of both China＇s legal history and history of the nation as a whole, the study of each ethnic minority group＇s legal history has become necessary and possible. Research findings in this respect can facilitate in -depth excavation of the legal cultural heritage of ethnic groups, ethnic legal studies, and our current work in improving the ethnic legal systems.
