| 摘 要： | 精神损害赔偿制度是衡量一国民主法治进程的重要尺度。建立国家侵权精神损害赔偿制度不仅是现实的需要,也是法理的使然。文章以法哲学的视角从精神利益可物化性、人性发展、人权保护、法制统一、平等、公平原则等方面进行了法理分析。
