| 摘 要： | 自然法是与国家制定的实在法相对称的法律,它在西方法治中占据重要地位。它是孕育西方法治的思想渊源,是指引西方法治生长和发展的价值基础。本文正是通过对西方自然法的历史梳理与法治的辨析,从而揭示出二者之间的内在关联性,提出自然法是西方法治的生长点这一命题。

| Abstract: | Natural law is the law which corresponds with national laws,it plays an important role in western law and order.It is the origin of thought of western law and order.And it is the basis of value in the growth and development of western law and order.The article mainly analyses the historical development of natural law and western law and order,reveals the internal relation between them and thus raises a subject that natural law is the starting-point for western law and order. |
