政治公众人物隐私权特殊保护的原则

隐私权是自然人所享有的人格权中的一项重要内容,一般情况下是受到法律严格保护的,政治公众人物隐私权的保护与普通人物隐私权的保护存在差别。本文认为政治公众人物隐私权应该特殊保护,应该在保护其核心隐私的基础上对其隐私加以限制,在此基础上提出了特殊保护的五条原则:人格尊严不受侵犯原则、保守国家机密原则、公共利益优先原则、职务适应性原则、公开场所原则。

Special Principles of Protecting the Privacy of Public Personalities

Right of privacy is one of the important personal rights enjoyed by every natural person,which is normally strictly protected by laws.Protecting the public personalities' rights of privacy is quite different from that of the ordinary public.In this article,the author,based on the idea that the public personalities' rights of privacy should be restrictively protected in special ways,has put forward five special principles,namely, non-infringement of their dignities of human personalities;protection of state secrets;the priority of public interests;the adaptability of holding one's position;the protection of privacy in public.
